Terms of Use

Summary

These Terms govern your use of Poreless, including our mobile apps, related websites, AI-powered skincare tools, subscriptions, and related services (together, the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

Operator: Poreless Skin AI Limited (“Poreless”, “we”, “us”, or “our”).

Scope: These Terms apply to the Poreless app and related services offered by us.

Billing: Paid subscriptions renew automatically unless cancelled through Apple App Store or Google Play.

Important: Poreless provides cosmetic and general skincare information only. Face Scan, Product Scan, Routine Planner, and AI-generated outputs may be inaccurate or unsuitable for you and are not medical advice, diagnosis, treatment, or emergency care.

1. Using Poreless

Poreless provides tools such as face and skin-appearance scanning, skin reports, skin tracking, Product Scan, Routine Planner, and AI-generated cosmetic skincare guidance.

You may use the Service only for lawful, personal, non-commercial purposes and in compliance with these Terms. If you use the Service for an organisation, you confirm that you have authority to accept these Terms on its behalf.

The Service is not a medical device. Do not use it to make medical decisions, diagnose or treat a medical condition, or respond to an emergency. Seek advice from a qualified healthcare professional for serious, persistent, worsening, unusual, or urgent skin concerns, suspected infection, severe reactions, or any medical emergency.

You are responsible for reviewing product labels and ingredients, considering allergies and sensitivities, patch-testing where appropriate, and following the manufacturer's instructions, warnings, and directions. Poreless does not manufacture, sell, endorse, or guarantee third-party skincare products unless we expressly state otherwise.

2. Accounts and Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with parent or legal-guardian permission and supervision where required by applicable law.

You may create one account per email address. You must provide accurate account information and keep it current. You are responsible for safeguarding your password, sign-in credentials, and device, and for activity through your account unless it results from our own security failure.

Do not share, sell, rent, transfer, or provide another person access to your account. Tell us promptly at support@poreless.org if you believe your account has been accessed without authorisation.

3. Privacy, Your Content, and AI Outputs

Our Privacy Policy explains how we collect, use, disclose, store, and protect personal data. It forms part of these Terms.

Certain features require us to process information you provide, including skin photos, skin-profile information, product names, product details, ratings, reviews, and feedback. You retain ownership of the content you submit. You grant Poreless a limited, worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce, format, transform, and transmit that content only as needed to operate, secure, support, and improve the Service.

AI Skincare Guidance / Product Scan is optional. If you enable it, we may send selected product and non-identifying skin-profile information to an external AI processing provider acting on our behalf to generate general cosmetic guidance and product-scan results. We do not send your account password or original face/skin photo to that provider for this feature.

AI-generated outputs can be incomplete, inaccurate, outdated, biased, unavailable, or unsuitable for your circumstances. You are responsible for reviewing outputs before relying on them and must not treat them as medical, legal, professional, or other regulated advice.

Only submit content that you have the right to use. Do not submit content that infringes another person's rights or includes personal, sensitive, medical, account, or confidential information that you do not have the right to provide.

4. Free, Pro, and Max Subscriptions

Free includes limited Face Scans, reports, and skin tracking for personal use, plus one Product Scan trial and one Routine Planner trial per account. Pro includes unlimited Face Scans and Product Scan and Routine Planner access with a Standard Limit for regular personal AI use. Max includes a Higher Limit for frequent personal AI use and deeper research for Pore & Routine plans and Product Scan, which checks more sources and may take a little longer. AI features are subject to reasonable-use, security, and service-capacity limits. Prices, billing periods and any applicable taxes are shown in the app before you subscribe and may differ between the App Store and Google Play and by country or region. My Shelf is available on all plans: Free includes one shelf item, and Pro and Max have no shelf item limit.

5. Billing, Cancellation, and Refunds

Paid subscriptions renew automatically unless cancelled through Apple App Store or Google Play before the next renewal is processed, subject to the applicable store rules. Payment is charged to your Apple ID or Google Play account when you confirm the purchase. To avoid being charged for the next period, turn off auto-renewal at least 24 hours before the current period ends. You can manage or cancel your subscription in your Apple ID or Google Play account settings. Apple or Google determines upgrade, downgrade, cancellation, proration, and billing timing. Deleting the app does not cancel an active subscription. Refunds are handled by Apple or Google under their applicable policies, except where law requires otherwise.

6. Reviews and Acceptable Use

You may be able to submit ratings, reviews, and feedback. Public reviews are intended to appear anonymously, but review text can reveal personal information if you include it. Do not include your name, contact details, address, passwords, medical information, or information about another person in a review.

You retain ownership of reviews you submit. You grant Poreless a limited licence to host, store, format, reproduce, display, and distribute reviews as needed to operate the review feature. We will not use a review as a marketing testimonial, advertisement, social-media post, or case study without your separate express permission.

You may edit or delete your own review through the Service. We may review, moderate, hide, refuse, or remove reviews or other User Content when reasonably necessary to operate the Service or address legal, safety, security, abuse, or policy concerns.

You must not use the Service to:

• Break the law, infringe rights, commit fraud, harass, threaten, deceive, or harm another person.
• Submit abusive, hateful, defamatory, misleading, unlawful, infringing, spam, promotional, unsafe, or otherwise inappropriate content.
• Use bots, scripts, automation, scraping, crawling, data extraction, reverse engineering, decompilation, or security probing.
• Circumvent subscription controls, reasonable-use controls, rate limits, authentication, security features, or plan restrictions.
• Share accounts, resell access, offer the Service commercially, or provide AI-powered features to others without our written permission.
• Interfere with, disrupt, overload, or compromise the Service or its providers.

7. Poreless Intellectual Property

Poreless and its licensors own the Service, including its software, design, interfaces, branding, trademarks, logos, text, graphics, workflows, reports, analysis methods, and related materials. These materials are protected by intellectual-property and other applicable laws.

Subject to your compliance with these Terms, Poreless grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to download and use the Service for personal, non-commercial use.

Except for that limited licence, no rights are granted to you. You may not copy, sell, resell, lease, distribute, modify, create derivative services from, or otherwise exploit the Service except where applicable law or our written permission allows it.

8. Product Information, Prices and Brands

Product recommendations, names, sizes, prices, launch dates and retailer links are compiled with the help of AI from publicly available sources when a plan is generated. They are for reference only, may be inaccurate or out of date, and exclude tax and shipping. Check the retailer's website for the current price, availability and product details before buying. Purchases are made directly with the retailer, and Poreless is not a party to those transactions. Poreless is not affiliated with, sponsored or endorsed by any brand or retailer shown in the app. Brand names and trademarks belong to their owners and are used only to identify products. Poreless does not receive payment for recommending any product.

9. Product Scan, My Shelf and Ingredient Information

Product Scan reads ingredient information from the photo you take and from public sources, and uses AI to provide general information about the ingredients. Text recognition can miss or misread ingredients, product matches may be uncertain, and formulations can change, so the packaging of the product you have is always the authoritative source. Ingredient findings, scores and suitability notes are general information, not personalised medical advice, and are not a substitute for a patch test or professional advice. If you have known allergies, sensitive skin or a skin condition, or are pregnant or breastfeeding, consult a doctor or pharmacist before using a product, and stop use if irritation occurs. My Shelf ingredient timing hints are based on general ingredient rules and the ingredient information available for each product, may be incomplete, and are not personalised medical advice. Opened-date countdowns and reminders are estimates based on the dates and period-after-opening settings you enter; always follow the product packaging, and stop using a product that has changed in colour, smell or texture. My Shelf data is stored only on your device and is not backed up by Poreless, so it may be lost if you delete the app, clear its storage or change devices.

10. Suspension and Termination

You may stop using the Service and delete your account at any time.

We may suspend, limit, or terminate access to all or part of the Service if we reasonably believe that you have violated these Terms, created a legal, security, safety, fraud, payment, operational, or reputational risk, misused AI-powered features, submitted prohibited content, or used the Service in a way that harms users, providers, or the Service.

Where reasonably practicable, we will give notice before suspension or termination. We may act without prior notice when necessary to protect users, prevent fraud, comply with law, address a security risk, or prevent material harm.

Termination does not automatically cancel an active Apple App Store or Google Play subscription. You must manage cancellation through the applicable app store.

11. Disclaimers and Limitation of Liability

To the fullest extent permitted by law, the Service is provided on an “as is” and “as available” basis. Poreless does not guarantee that the Service will be uninterrupted, secure, error-free, timely, accurate, complete, compatible with every device, or suitable for your specific needs.

Poreless does not guarantee the accuracy, completeness, safety, efficacy, availability, regulatory status, product information, ingredient information, suitability, or outcome of any skin analysis, Product Scan, Routine Planner output, AI output, third-party product, or third-party content.

To the fullest extent permitted by law, Poreless and its affiliates, directors, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, business opportunity, or anticipated savings.

To the fullest extent permitted by law, Poreless's total liability for all claims arising from or relating to the Service or these Terms will not exceed the greater of:

1. the amount you paid directly to Poreless for the Service in the 12 months before the event giving rise to the claim; or
2. HK$1,000.

Nothing in these Terms excludes or limits liability, rights, warranties, or remedies that cannot lawfully be excluded or limited.

12. Indemnity

To the extent permitted by applicable law, you will indemnify and hold harmless Poreless and its directors, officers, employees, contractors, licensors, and service providers from reasonable losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising from your unlawful User Content, misuse of the Service, infringement of another person's rights, or breach of these Terms.

This applies only to the extent a claim results from your actions or omissions and does not limit rights that cannot lawfully be waived.

13. Governing Law, Disputes, and Contact

Before starting formal proceedings, you and Poreless agree to try to resolve a dispute informally for 30 days after one party gives the other written notice. Notices to Poreless should be sent to support@poreless.org.

These Terms are governed by the laws of Hong Kong, without regard to conflict-of-law principles. Subject to mandatory consumer-protection law, the courts of Hong Kong have exclusive jurisdiction over disputes arising from or relating to these Terms or the Service.

If you live in a place that gives you mandatory consumer rights that cannot be waived, those rights remain unaffected.

14. Changes to These Terms

We may update these Terms from time to time. For material changes, we will provide at least 14 days' notice before the updated Terms take effect where reasonably practicable. We may make changes effective sooner where necessary for legal compliance, security, fraud prevention, urgent operational reasons, or to prevent harm.

We will post the updated Terms in the Service and revise the “Last updated” date. If you continue using the Service after the updated Terms take effect, you accept them. If you do not agree, stop using the Service and, if applicable, cancel your subscription through the relevant app store.

15. General Terms

These Terms, the Privacy Policy, and applicable app-store purchase terms are the entire agreement between you and Poreless concerning the Service.

If any provision is unenforceable, it will be enforced to the maximum extent permitted by law and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, financing, restructuring, or sale of assets, subject to applicable law.
